NIS2 is now fully in force. Legal Notice 71 of 2025 published the Order transposing NIS2 as Subsidiary Legislation 460.41. Legal Notice 22 of 2026 then brought every provision into force on 23 January 2026. The Critical Infrastructure Protection Department supervises most sectors, while the Malta Communications Authority covers digital infrastructure and postal services.
Incident reporting runs on a short clock. Covered entities must warn the national CSIRT within 24 hours of a significant incident and send a fuller notification within 72 hours. They must also register through the national self-registration mechanism run by the CIPD.
Data protection has a Maltese layer. The Data Protection Act, Chapter 586, took effect on 28 May 2018 beside the GDPR. The Information and Data Protection Commissioner receives breach reports within 72 hours. Fines on public authorities are capped at €25,000 or €50,000 per violation, plus a daily penalty.
AI oversight is being assigned. Malta has identified the Malta Digital Innovation Authority and the IDPC as market surveillance authorities under the EU AI Act. Firms building or deploying AI in Malta should expect questions from both.
