Congolese Rules in 2026 That Shape Certification Requests
Personal data has its own law and regulator. Law No. 29-2019 of 10 October 2019 on the protection of personal data was published in the Official Journal on 7 November 2019. Most processing must be declared to the national commission before it starts. Biometric data, health research, national identifiers, criminal records, and file interconnections need prior authorization. Law No. 5-2025 of 29 March 2025 created the Commission Nationale pour la Protection des Données à caractère personnel (CNPD).
Breaches and transfers carry clear duties. Controllers must notify the commission of a personal data breach without undue delay and, where possible, within 72 hours. People must be told when the breach is likely to create a high risk for them. Transfers abroad need a sufficient level of protection, and the controller must inform the commission beforehand. Administrative fines run from 1 million to 100 million CFA francs.
Cybersecurity has a national agency. Law No. 30-2019 created the Agence Nationale de Sécurité des Systèmes d'Information (ANSSI), placed under the Presidency.
